BMW case: MLA son claims driver behind wheels

Jaipur, July 3: The speeding BMW supposedly belonging to Independent MLA, Nandkishore Maharia, and being driven by his drunk son Siddhrath Maharia, killed three innocent people on the spot and injured five others. But today the police got only one day for his custody even though they had applied for three.

Booked under Section 304 of IPC, which amounts to culpable homicide , not amounting to murder, is a nonbailable offence.

Siddhrath claims that it was driver Ramesh Singh, who was behind the wheels and not him,


The accident occurred around 2 am on Friday night (i.e Saturday morning) on one of the main thoroughdfare roads of Jaipur, when the BMW being driven by Siddharth, 24, first rammed into an auto, tossing it into the air, which made it crash land onto the road, killing three on the spot. There were three people at the back. Two of them died while the third one escaped miraculously.

The auto driver, identified as Kailash, was also killed. The other two killed are 31-year-old Jethalal, who used to work in a shoe shop. The third person killed was 45 year-old Vishnu Das, a readymade cloth seller for the last 22 years.

The speeding car then hit a stationed police van, injuring four policemen in it. One of the policemen, Rajju Singh, was injured seriously with head and ear injuries. He has been admitted to the Sawai MAnsingh Hospital and is recuperating in the trauma centre. The other policemen received minor injuries.

Siddharth was with his cousin Jayant at the time of the accident. The police said prima facie it seems they were under the influence of alcohol and were returning from party.

The police had applied for three-day police custody but had to be satisfied with the court’s decision for one day.

Siddhrath’s lawyer Deepak Chauhan said that Siddhrath was not driving the car and it was his driver Ramesh Singh, who was behind the wheels. He said : “Ramesh, who is Siddhrath’s regular driver for the last five to six years, fled after the accident, fearing the wrath of public and the police. Ramesh later went to the police but the police was unwilling to investigate his side.And that is why he filed an application the court.”

Chauhan also said that the FIR in this accident case was filed 12 hours after the accident, which is strange and seems to be a conspiracy against Siddhrath and an attempt to malign the name of his family.

Kamal Nayan, the investigating officer, however said that no Ramesh Singh has approached them. He said : “If he turns up, we would investigate. But as of now, there are eyewitnesses and policemen, who have said that Siddhrath was driving the car recklessly. So we are investigating on those lines only.

He also said: “The CCTV footage cannot confirm who was actually behind the wheels. It can only display the direction and speed of the car.”

Siddhrath’s family is rich and influential and is into mining and automobile. Sources say that Siddharath is into heavy drinking and probably into drugs. His father MLA Maharia’s assets are valued over Rs 9 crore in his 2008 election affidavit.

Siddhrath has been arrested under Section 304 of IPC, which is culpable homicide , not amounting to murder, the punishment of which entails life imprisonment or 10 years or more along with a fine.

Deputy Commissioner of Police ( South), Jaipur, Manish Agarwal said that traces of alcohol (152mg) was found in the breath analyser test conducted by police on the spot. He said : “ Siddhrath’s cousin Jayant also tested positive with 86 mg of alcohol. Their blood samples and CCTV footage have been sent for tests, the results of which are expected on Monday.”
The permissible limit of alcohol in blood under the Motor Vehicles Act is 30 mg per 100m ml of blood.

About the speed, Agarwal said : “The actual speed can be ascertained only after CCTV footage is analysed but it must be somewhere between 100 to 120 km per hour.”

The BMW is a 520d sedan and costs around Rs 50 lakh and allegedly belong to MLA Maharia from Fatehpur, Sikar (120 km from here). The BMW was also damaged with bonnet, piston crushed and tyres burst.

The police is however not sure about the ownership of the acr as they are yet to get the registration papers.

MLA Maharia had won 2008 Assembly elections on a BJP ticket. He did not get a BJP ticket in 2013 but won as an Independent candidate. Political observer, however, say, Maharia is aligned to BJP and had supported the party in the recent Rajya Sabha elections.
